NETVIGATOR Anti-Spam Policy
¡§We¡¨ or ¡§us¡¨ means PCCW IMS Limited. ¡§You¡¨ means any NETVIGATOR Service subscriber or any person who sends emails and/or files to any NETVIGATOR Service subscriber.

We prohibit the use of any NETVIGATOR Service (which shall mean the NETVIGATOR Broadband service or the NETVIGATOR 56K service) or your NETVIGATOR email account for purposes relating to the transmission, distribution or delivery of any unsolicited (single, bulk or commercial) message (including but not limited to newsgroup post) and/or unsolicited (single, bulk or commercial) email (¡§Spam¡¨). You shall not yourself, and shall ensure that no-one uses your NETVIGATOR login ID and password to access the NETVIGATOR Service to:

1) deliver Spam; or
2) directly or indirectly cause Spam to be delivered to any person.

You must ensure that all e-mails sent, or caused to be sent, to or through the NETVIGATOR Service will not:

1) use or contain invalid or forged e-mail headers;
2) use or contain invalid or non-existent domain names or other deceptive addresses;
3) use another third party's internet domain name, or be relayed from or through a third party's equipment, without permission of the third party;
4) employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path;
5) contain false or misleading information in the subject line or otherwise contain false or misleading content;

Furthermore, you shall not yourself, and shall ensure that no-one uses your NETVIGATOR login ID and password to access the NETVIGATOR Service to:

a) upload, post, email or transmit any message, material, URL or post any content that is unlawful, improper, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially objectionable, fraudulent, misleading, in breach of any confidentiality obligation, infringes any third party's intellectual property rights or proprietary rights, contains software viruses, destroys, interrupts or affects the functionality of any computer software or hardware or telecommunications equipment;
b) carry out harvesting, mining or collection of e-mail addresses or other information from or through the use of any NETVIGATOR Service for purposes of sending unsolicited or unauthorized material;
c) collect, compile or obtain any information about NETVIGATOR Service customers or subscribers, including but not limited to subscribers¡¦ email addresses and other confidential and proprietary information.

Please NOTE that we will take appropriate action (including commencing legal proceedings) against anyone who breaches our NETVIGATOR Anti-Spam Policy. Such action may include but is not limited to blocking messages from a particular mail server or IP address, suspension or termination of your subscription to any NETVIGATOR Service. Our failure to enforce this policy in every instance in which it might apply does not amount to a waiver of our rights.

The use of any NETVIGATOR Service is also subject to the Terms and Conditions applicable to that NETVIGATOR Service and the PCCW Privacy Policy.

1. What is SPAM?

SPAM refers to unsolicited (single, bulk or commercial) junk emails - generally product advertising sent wide-scale to a mailing list or newsgroup without the recipients' prior request or consent. Examples are unsolicited commercial email messages and the posting of an identical news article individually to many newsgroups.

2. What causes SPAM?
As Internet Service Providers (ISPs) do not charge on the basis of the number of emails sent, spammers do not need to pay extra to send large quantities of spam which can reach people all over the world simultaneously, making spam a means of low-cost direct marketing. However, more and more ISPs are blocking spammers who try to hide their real identities. There is a trend toward spammers using Spyware or Trojan house programs to make a victim's PC send out spam for them. Some virus programs also turn the victim's PC into an Open SMTP server that sends out bulk emails to spread the virus.

3. What will NETVIGATOR do when customers are caught spamming?
NETVIGATOR will take action against anyone in breach of our anti-spam policy, including service suspension without prior notice. In the event that the customer has a service commitment with us, upon involuntary suspension, the customer has to pay any early termination fees, if applicable.

4. Does NETVIGATOR's Terms and Conditions stating users are prohibited to SPAM?

5. Does NETVIGATOR's Terms and Conditions stating users are prohibited to send virus-infected email?
NETVIGATOR may delete any suspected spam email, virus-infected files and/or emails without prior notice. We recommend users to refer to the clause no. 1 -¡§Our responsibilities¡¨ in NETVIGATOR's service Terms and Conditions for details.
